Chairman Bill Stuteville called the meeting to order. Jerry Trapp was absent from the meeting. Minutes from the February meeting were approved with corrections.
The first item on the agenda was Triton Development LLC. With petition from the zoning commitments in connection with development of real estate that was annexed into Lebanon in 2003 of approximately 60-acres bordering the Wal-mart Plaza shopping center, the railroad tracks, and County Road 250 North. The petitioner requests to be tabled until the April meeting.
The second item on the agenda was Americare Communities requesting Rezoning application for a Senior Housing project on 5.20 acre parcel located to the north of the existing Assisted Living Center on Crown Pointe Drive. The property is currently zoned PB requesting rezoning to SF-3. Steve Bourquein with Pendleton Consulting and Scott Neff with Americare Communities were present to introduce the plans. Pete Fritz contracted planner for the City stated that the applicant has meet with staff and with TAC for review since this is a rezoning petition they do not have to have full development plans at this time they have presented a conceptual plan for the project. Staff supports the rezoning for the senior housing project. The project would consist of duplex homes that would be entirely bricked to match the existing assisted living centers façade with 2-car attached garages. The total square footage of living space would be between 1600-1700 sq. ft. The assisted living center would be in charge of all maintenance issues with this development. This would be an alternative step before they needed to enter the assisted living center. The owners of the duplexes would be able to utilize the same services of the residents. The developers have been asked to provide an easement for the property owners to the west of this lot along State Road 39 for access to tie into the sanitary if needed. All details have not been worked out to where the access would be but it will be available. The definite price range has not been set normally in other communities it is around $159,000-$189,000. The street would be a private street built to City specifications. The street will only be 24’ wide, which does not meet City standards. Jim Nelson asked if the street could be widened to at least 26’ wide. Bob Waples stated that he would rather the site be moved to another area and leave the PB zoning for another commercial development. There is not a definite plan for the rest of the property at this time it will depend on the Hospitals need to expand and the desire for more senior development in the community. If the street is private then the property owners should be made aware of the responsibility and contact person for all maintenance issues. Keith Campbell made a motion to send a favorable recommendation to the City Council with the rezoning designation of SF-3. Jim McVey seconded the motion. Bob Waples opposes. Motion carries.
The third item on the agenda was City Attorney Larry Giddings to present voluntary annexation of 6-parcels on the west side of North State Road 39. Properties include A) Wyatt property located at 2570 N. State Road 39; B) Davies property located at 2710 N. State Road 39; C) Meyers property located at 2700 N. State Road 39; D) Stockton property located at 2680 N. State Road 39; E) Burkholder property located at 2620 N. State Road 39; F) Stewart property located at 430 W. 250 North. Larry Giddings stated that the annexation is in connection and agreement with the property owners to obtain easement for the utilities for the sanitary force main that is in this area. The Lebanon Utilities needs to obtain about a 20 foot easement and agreement with the current property owners they will not have to hook up to the services unless the property is sold and the intention for this area will be commercial growth if the property is sold then they will be required to hook into the utilities. The zoning requested will be PB Planned Business. The Hospital property and the property to the south are zoned PB and the intention is the Lebanon Street corridor be zoned PB. Mayor Acton made a motion to send a favorable recommendation to the City Council. Jack Bland seconded the motion. Motion carries.
The fourth item on the agenda was Voluntary annexation of 34.011 acre parcel petitioners Kanene Summers, Michael Neese and Kethlene Scheick; the property is located to the east of Auburn Meadows Subdivision and the south of East County Road 300 North. Randy Holt attorney for the petitioners stated that his clients do not have an intended plan for the site at this time and are asking for the zoning classification of SF-2. Auburn Meadows Subdivision is zoned SF-2 as well. Any new development will have to comply with the thoroughfare plan for the extension of John Bart Road. Pete Fritz contracted planner stated that this annexation and zoning classification does comply with the comprehensive plan. Staff is in favor of the request. This would go to the City Council on April 9, 2007. Jack Bland made a motion to send a favorable recommendation to the City Council for annexation and zoning classification of SF-2. Emmadell Sturgis seconded the motion. Motion carries.
